1.1 This site is owned and operated by Gum Mobile UK

1.2 All rights in this website are owned by Gum Mobile UK. Any unauthorised use, copying or modification is prohibited.

2.0 Website Order
2.1 All orders placed through our website will be subject to our acceptance
of the order. We reserve the right to decline any order for any reason at
any time.

2.2 Once an order is placed on our website, you will receive confirmation
email via the address you supplied during registration. A contract will be
formed between yourself and Gum Mobile UK upon our acceptance of the order.
A further email will be sent to confirm your order has been accepted and
your items dispatched.

2.3 If you have redeemed and promotional or voucher code on your order, the
order will not be completed until the code has been checked. Checking
includes: whether the code was issued for your personal use, is used in
conjunction with the terms of voucher codes or is still valid. We reserve
the right to withdraw the code if it does not comply with these terms.

3.0 Order Cancellations

3.1 You have the right to cancel an order within 7 days after the day the
goods were delivered provided the are still sealed and in the original
condition. By unsealing and using the product you accept the terms of order
cancellation. If we are buying in the product exclusively for you, you
accept that the order cannot be cancelled once the transaction has been
processed and initiated.

3.2 If you wish to cancel your order you must notify Gum Mobile UK via
returns@gummobile.com within the stated 7 day period, cancellations after
7 days will not be accepted. Upon notifying Gum Mobile UK of your
cancellation Gum Mobile UK will issue you with a unique RMA number. You must
return the goods to Gum Mobile UK or one of our registered service centres
in the same condition and completeness as Gum Mobile UK delivered them to
you, please note this includes, packaging, manuals, cables, software etc. If
you do not return the goods in the same condition and completeness, Gum
Mobile UK at its sole discretion can either reject the cancellation or levy
a 5% charge against you or your credit card to make good any use, damage or missing
items (20% for International orders). Once we have issued the RMA number you have 7 days to return the goods to us.

3.3 The goods remain your property and responsibility until such time as Gum
Mobile signs acceptance of the return delivery of the goods. We strongly
advise you to use a secure signed-for service, for example Royal Mail
Special Delivery, and you should note that the cost of returning the goods
is your responsibility. Should you wish to return any goods, please go to
the Returns section for further information.

4.0 Processing your orders and payment
4.1 Whilst it is our intention to keep our website up to date and error
free, product description or pricing errors may occur. If we discover such
an error after you have submitted an order to us, we will contact you prior
to accepting your order with the correct details. You may then either cancel
your order or re-confirm it based on the correct information. If we are
unable to contact you, we will treat your order as cancelled.

4.2 All prices shown on our website are inclusive of VAT. Delivery charges
are clearly highlighted throughout the site. For further information on
delivery charges see the Delivery section of the Terms and Conditions.

4.3 Cards are processed and funds are debited upon order being placed and
completed through PayPoint.net. This also applies to any items available for Pre-Order or Coming soon.

5.0 Delivery
5.1 Some postal addresses in Northern Ireland, some offshore islands and
some remote areas of Great Britain may not be covered by our delivery
services and we may not be able to arrange delivery of some items to such
addresses. You will be notified of this when you place your order if there
is any problem.

5.2 Whilst we make every effort to deliver goods on the day we specify, we
cannot guarantee delivery on that day or accept liability for deliveries
made outside this timescale. We cannot accept liability for out of pocket
expenses or other costs incurred due to failed or delayed deliveries.

5.3 All items are subject to stock availability.

5.4 When we deliver your items to you will be asked to sign for the goods to
acknowledge that you have received them.

5.5 If your goods fail to arrive within 15 days of dispatch, you will have
the option of either a full refund or a replacement shipment as soon as we
have investigated with the courier.

5.6 Where an incorrect address has been given to Gum Mobile UK, with the
order we reserve the right to charge for any extra carriage costs incurred.

5.7 Claims for damage, delivery discrepancy etc. should be made within 48
hours of delivery - claims will not be accepted after this time. Please sign
the consignment document 'UNCHECKED', as we cannot otherwise accept any
claims for damage in transit.

5.8 A proof of delivery for consignments dispatched with DHL can only be
provided up to 90 days after dispatch. DHL delete their records after 90
days. All orders to be shipped by DHL which are received after 1pm will not
be dispatched until the following working day.

5.9 Gum Mobile UK is a global business who sell and deliver products to all
areas of the world. Please check our delivery rates below.

6.0 Returns
6.1 Any faults that occur within the first 14 days after the goods arrive
must be reported to Gum Mobile within this time frame to be eligible for
refund/replacement. Goods with faults reported outside the first 14 days
after the goods arrive should be sent to the manufacturer for repair. Please
note that packaging must be in pristine condition to be eligible for a
refund, and all goods will be tested if reported faulty upon their return
either by Gum Mobile technical advisor, manufacturers or a local service
centre.

6.2 If the goods are not faulty you have 7 days from the day after the
goods arrive to cancel the order and return the goods for a refund (click
here to find out how to return goods). The goods must not have been unsealed or used in anyway,
and be returned as received to be eligible for a refund in this circumstance. A refund will be provided within 30
days. Please note that packaging must be in pristine condition or Gum Mobile
will charge the customer a 5% restocking fee to compensate Gum Mobile for the written down
value of the stock. Return shipping is at the customer’s expense. The refund
value will not include the additional postage cost incurred by us for the
delivery. Any customers wishing to return the item after 7 days will be offered store credit.

6.3 If any goods are returned in an incomplete manner, Gum Mobile at it's
discretion can either reject the returned item as incomplete and return the
goods at the customers expense, or Gum Mobile can charge the customer a sum
equivalent to the replacement cost of the missing item - this can include
small items such as manuals, cables, batteries, stylus, and any other
products supplied within the package. If we cannot replace the missing items
(e.g. replacement hard copy manuals are very difficult to replace) then Gum
Mobile will charge the customer a fee to compensate Gum Mobile for the
written down value of the incomplete stock.

6.4 If you wish to return any goods you must notify Gum Mobile and we will
issue you with a unique RMA number if the return is authorised. Please note
that you should not send any goods back until you have received this RMA
authorisation number, otherwise we will be unable to process your return.

7.0 VAT, Import Duty and Other Sales Taxes
7.1 All prices listed on the site include VAT unless stated otherwise.

7.2 Many countries charge duty on products upon arrival or delivery to that
country. Gum Mobile is not responsible for the rates charged to the customer
and any disputes should be taken with customs authorities within that
country.

8.0 Privacy
8.1 We do collect the information given at the time of your order. This
information is not disclosed to any third party and is collected by Gum
Mobile UK. We do not sell any information collected and is only used by Gum
Mobile communications between Gum Mobile and our customers. All information
is collected lawfully and in accordance with the Data Protection Act 1998.

8.2 We aim to offer a top quality service at the best price possible, to do
this we need to reserve the right to change the above policies at any time.

8.4 If you wish to opt out of any postal marketing please email your details
to customer.services@gummobile.com.

8.5 We can provide a full schedule of all information collected on an
individual for a fee of £20.00; we will require significant proof of
identification. In accordance with the Data Protection Act 1998 the
information will be provided within 30 days of required level of
identification.

9.0 Security
9.1 All transaction are secured and vetted by paypoint.net and Barclays PLC.
The card details supplied must match the billing address of the customer and
will be checked to ensure transaction has been authorised by the correct
person.

9.2 If you have any questions about security at Gum Mobile please contact
customer.services@gummobile.com

9.3 We will take all reasonable precautions to keep the details of your
order and payment secure, but, unless we are negligent, we cannot be held
liable for any losses caused as a result of unauthorised access to
information provided by you.
9.4 All customers are required to keep log in details safe and unsure no one
but yourself can access your account. Gum Mobile UK will not be held liable
for customers being negligent of their own customer login details.

10.0 Pricing
10.1 Whilst we endeavour to ensure the prices on our website are as accurate
as possible, we reserve the right to change a price in exceptional
circumstances. If a price is corrected due to exceptional circumstances,
customers will be informed of the change before payment is processed and
offered the opportunity to cancel the order.

10.2 Prices on orders for out-of-stock or pre-release items are valid for
one week after the order is placed. If the price changes when the stock
becomes available customers will be informed of the change before payment is
processed and offered the opportunity to cancel the order.

11.0 Business Customers
11.1 If you are a business, you will not export any goods purchased from us
in contravention of United States of America export controls.

12.0 General
12.1 The use of our site and any contracts formed are governed by English
law.

12.2 We shall not be responsible to you whether in contract, tort (including
negligence) or otherwise for incidental, special, indirect or consequential
loss or damage, any loss of profit (direct or indirect), loss of sales, loss
of goodwill or reputation, loss of business, third party claims, pure
economic loss arising out of or in connection of the performance or non
performance of our obligations under these terms and conditions including
such damage as may be reasonably foreseeable at the date you order the
goods.

12.4 Our liability for any claim for loss or damage shall be limited to the
sum paid by you for the goods.

12.5 A person who is not a party to these terms and conditions shall have no
right to enforce any term under the Contracts (Rights of Third Parties) Act
1999.

12.6 If any provision of these terms and conditions is found to be invalid
or unenforceable by a court the invalidity or unenforceability of such
provision shall not affect the other provisions of these terms and
conditions.

12.7 We may assign or transfer any of our rights or sub contract any of our
obligations under these terms and conditions to any third party.

12.8 You may not assign or transfer any of your rights or sub contract any
of your obligations under these terms and conditions except with our
specific permission in writing.

12.9 We reserve the right to change these terms and conditions from time to
time and any such changes will be communicated on our website.

12.11 These terms and conditions govern the entire trading relationship
between you and ourselves and will remain in force for the duration of our
trading relationship.

12.12 All intellectual property rights (including use of trade marks) shall
be solely owned by us. You are permitted only to use material on this
website as expressly authorized by us or our licensors.

12.13 Any unauthorized use of material on this site is strictly prohibited.

13.0 Vouchers
13.1 We offer free Discount Vouchers to customers as a marketing tool.
Discount Vouchers may not be used in conjunction with any other offer where
we decide at our sole discretion that they may not be used. Discount
Vouchers cannot be used when purchasing memory cards or USB flash disks.

14.0 Recycling Terms

14.1 Our recycling services are conducted off site by an approved recycling
partner.

14.2 Once a customer requests to recycle their mobile phones with Gum
Mobile, we will issue a collection or send a paid envelope in order to
retrieve the phone, which ever is available based on the customers
destination within the UK.

14.3 Any customers outside of the UK are responsible for the cost to deliver
the mobile phone to us.

14.4 All prices stated on the recycling page are an “up to” value. Actual
price is determined by overall quality and condition of the mobile phone. We accept damaged (broken) and working mobile phones which will be assessed and inspected on arrival to determine this.
To receive the full value of your mobile phone it should:

Power-up (turn on) and be in a working condition.
Not have significant damage although may have some mild cosmetic damage (general wear and tear).
Have its battery.
Not be barred or water damaged.
Be of UK / European specification

14.5 Once Gum Mobile UK has received the mobile phone they will issue the
customer with a final value for cash or credit via their email linked to the
account. We give the customer 7 days to accept or cancel the process from
this point. If the customer fails to respond and accept, we will assume acceptance and a cheque will automatically be issued.

14.6 Any customers outside the UK have the right to cancel during the 7 day
acceptance period. Gum Mobile UK may only return the phone at the
customers own expense.

14.7 Payment is issued via cheque in the post to the customers supplied
address The cheque will be made out to the name associated with the account.
Credit is also an option for the customer. Credit may be a higher value than
a cash payment and will be issued in the form of a voucher code.

14.8 For bulk recycling services please contact us with the list of phones.
Gum Mobile UK will respond with a quote for the customer to accept. Upon
acceptance normal conditions apply. please contact via
recycling@gummobile.com.

14.9 We do encourage customers to send all original contents, ie. box, accessories and charger. Please note this may increase the value but not in all circumstances.

14.10. We recomend that you remove all personal data prior to sending the phone such as any text messages, contacts, photographs and any other details held on the phone. We recommend you reset the phone to its factory default to ensure everything has been deleted. Please ensure any sim cards or memory cards have been removed from the phone before sending. If we receive the phone with any sim card or memory card, unfortunatly we will not able to return them.

14.11 We are unable to return mobile phones that are sent to us and are accepted at full price or after a customer accepts a mobile phone value at a lower price. Mobile phones will be returned to customers only if a lower price is offered and rejected

15.0 Pre-Order (Coming Soon Section)
15.1 All phones within the coming soon pages are pre-order only. Any orders within this section will be dispatched on the date stated within the item description.

15.2 Release dates stated in the item description are based upon manufacturers release schedule and are subject to change. Any changes in release date will be displayed on the item description page and any associated customers will be notified by email.

16.0 E&OE
16.1 Errors and omissions must be excepted.

17.0 No effect to statutory rights
17.1 The above policies are part of our commitment to high quality service.
They do not affect your statutory rights as a consumer.

Building
